If you intend to create a User Account and use our services, you will be asked to provide us with your personal information.
Your data is processed by us for the purposes indicated below, related to the operation of the Store and the provision of the services offered therein (the "Services").
PURPOSE OF PROCESSING:
Depending on what you decide on, it could be:
- Implementation of your orders,
- The implementation of consumer rights and after-sales service of goods distributed by us and the processing of claims,
- to evaluate and analyze activity and information about you as a customer of the Nicopoder online store, including through automated processing of personal data (profiling), aimed at presenting general advertisements, offers and promotions of the Administrator's products or services in a manner tailored to your individual interests (without, however, producing any legal effects for you or materially affecting your decisions), as well as to customize the newsletter service (if you have given appropriate consent to receive non-public commercial information by means of electronic communication) and market and statistical analyses.
CATEGORIES OF PERSONAL DATA
To the extent specified in the paragraph above, we will process personal data provided in the relevant forms for placing an order or creating a user account (i.e.: name, surname, e-mail address or telephone number, delivery address) or consent to receive messages of a direct marketing nature (newsletter). In connection with order processing, we also process your bank account number, and in the case of issuing a VAT invoice, we additionally process your company name, address of residence or business address, VAT number. In terms of marketing activities, we will process the following data: name, surname, e-mail address).
BASIS OF PROCESSING:
- Sales contract or actions taken at your request to conclude it (Article 6(1)(b) RODO);
- Our legitimate interest in providing proper customer service to the online store and the proper performance of the respective sales contract relating to the goods we distribute in the online store (Article 6(1)(f) of the DPA);
- A legal obligation incumbent on us, e.g. related to accounting (Article 6(1)(c) RODO);
- Your consent given in the Store (Article 6(1)(a) of the RODO);
- A contract for the provision of services or actions taken at your request to enter into such a contract (Article 6(1)(b) RODO);
- Our legitimate interest in processing data for the purpose of establishing, investigating or defending possible claims (Article 6(1)(f) RODO);
- Your consent to carry out direct marketing activities, consisting of sending non-public commercial information to your indicated e-mail address by means of electronic communication (art. 6(1)(a) RODO);
- Our legitimate interest in conducting direct marketing (Article 6(1)(f) RODO);
- Our legitimate interest to process data for analytical and statistical purposes (Article 6(1)(f) of the DPA);
- Our legitimate interest in surveying customer satisfaction and to present general advertisements, offers and promotions of the Administrator's products or services in a manner tailored to your individual interests (Article 6(1)(f) RODO);
- In the event that you agree to participate in a non-public promotional event requiring separate registration, we will process the data you provide on the basis of a separate consent, i.e. on the basis of Art. 6(1)(a) RODO.
PROVIDING DATA:
- Voluntary, however, necessary to place an order within the online store and conclude a contract for the sale of goods available in the online store or register a user account in the Store or use other services (e.g. newsletter).
THE EFFECT OF FAILURE TO PROVIDE DATA:
Depending on the purpose for which the data is provided:
- No possibility to register in the Store,
- inability to use the services of the Store,
- inability to make purchases in the Store,
- No possibility to receive information about promotions or special offers, offered in the Store (newsletter).
ABILITY TO WITHDRAW CONSENT
To the extent that your data is processed by us solely on the basis of consent - you have the right to withdraw your consent to data processing at any time. Withdrawal of consent does not affect the lawfulness of processing that was carried out on the basis of your consent before its withdrawal. THE RIGHT TO LODGE A COMPLAINT WITH THE AUTHORITY
You also have the right to lodge a complaint to the supervisory authority in charge of personal data protection, i.e. the President of the Office for Personal Data Protection, located at 2 Stawki Street in Warsaw (postal code: 00-193).
PROCESSING PERIOD
We will process your data only for as long as we have a legal basis to do so, which is until:
- we are no longer under a legal obligation that requires us to process your data,
- there will be a statute of limitations on civil law claims to which the parties to the contract are entitled (there will be a period of limitation on claims).
- revoke your consent to data processing, if it was its basis, or at the latest after a 2-year period of inactivity on your part (no transactions within the online store, no response to our marketing messages), counted from the end of the calendar year, in which the aforementioned 2-year period expires, unless the circumstances indicated, above, apply (i.e. in the scope of data processing based on a legal obligation or in connection with securing civil law claims before the expiration of their limitation period).
- your objection to the processing of your personal data will be accepted - where the basis for the processing of your data was the legitimate interest of the Administrator or where the data were processed for direct marketing purposes, or at the latest after a 2-year period of inactivity on your part (no transactions within the online store, no response to our marketing messages), counted from the end of the calendar year, in which the above-mentioned 2-year period expires. 2-year period expires, unless the circumstances indicated, above, apply (i.e. in the scope of data processing on the basis of a legal obligation or in connection securing civil law claims before the expiration of their limitation period).
DATA SECURITY
When processing your personal data, we use organizational and technical measures in accordance with applicable laws, including the use of SSL certificate connection encryption.
PROFILING
Profiling in an online store Nicopoder, involves the automatic analysis or prediction of a person's behavior on an online store's website, e.g. by analyzing products added to a shopping cart, browsing a specific product page in an online store, or by analyzing a person's previous purchase history in the store.
To process users' personal data to the above extent, the Administrator uses automated processing tools such as Klaviyo, Hotjar or Google Analytics, for example. With the help of the aforementioned tools, the Administrator is able to assess personal factors concerning a specific user, and in particular to analyze or forecast aspects concerning, among other things, personal preferences, interests or behavior.
The above activities are aimed at presenting general advertisements, offers and promotions of the Administrator's products or services in a manner tailored to your individual preferences, interests or behavior, as well as for the purpose of customizing the newsletter service (if you have given appropriate consent to receive non-public commercial information by means of electronic communication) and market and statistical analyses. Thus, their purpose is to conduct activities of a direct marketing nature.
However, the forms of automatic analysis or behavioral forecasts used by the Administrator (i.e. forms of profiling) do not have any legal effects on users or do not significantly influence users' decisions, in particular, no decisions are made based on them concerning the conclusion or refusal of a sales contract or the possibility of using other services through the online store Nicopoder.
Not in every case the profiling activities described above will involve the processing of personal data. The condition for such processing is that the Administrator has the personal data of the person (user) in question.
TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA
In the event that it becomes necessary due to the services provided to the Administrator by the third parties mentioned in the paragraph above, we reserve the possibility of transferring your personal data to recipients located outside the European Economic Area and the European Union. We guarantee that the transfer will, in each case, comply with applicable data protection laws and ensure an adequate degree of protection for your data.

- withdraw your consent to the processing of your data for the purpose of creating and maintaining a user account and for direct marketing activities involving the sending of commercial information to the e-mail address you indicated by means of electronic communication,

- request the transfer of data to another controller,
- The right to object to the processing of your data on the grounds of your particular situation - in cases where we process your data on the basis of our legitimate interest (i.e. on the basis of Article 6(1)(f) RODO).
